Recent changes in mandatory California Law

Starting in 2011, every home with natural gas or wood burning fireplaces, cooking or heating requires a CO (Carbon Monoxide Detector), this is a statutory requirement, the same as smoke alarms.

New Rules regulating contractors or trades people working on property built prior to 1978 requires them to complete a course in dealing with lead paint. The penalties are severe and any work done by any contractor or trades person may be subject to this law, no matter how small the job.

Realtors®

When you're looking for help buying or selling property, it's important to remember that the terms "real estate agent" and "Realtor" are not synonymous. Mortgage Lenders

Providing mortgage financing for real property, these lenders take on several forms. A mortgage banker (Chase for example) provides loans generally with its own funds or a mortgage lender (Countrywide for example) used investor capital to fund many loans. Mortgage brokers bring together an outside lender and a borrower. Since each individual borrower has specific needs, many lenders work with portfolio loans (held by the bank), government insured loans ("Fannie Mae", "Freddie Mac", FHA, VA) or with other lending institutions as well as their own.

Escrow Companies

In California, a third (neutral party) instructed by the buyer & seller to deliver all instruments necessary to the sale (including funds) to the appropriate parties, i., e., lenders,  agents and the buyers or sellers. In recent years, many title & escrow companies have merged, providing both services.  A few independent escrow companies remain in this area and the buyer & seller, by mutual agreement determine which service company to use.

Home Inspection and Evaluation

          Natural Hazards

The Natural Hazards Disclosure Act of California, effective June 1, 1998

(as amended June 9, 1998), requires that seller of real property and their agent provide any prospective buyer with a "Natural Hazard Disclosure Statement" when the property being sold lies within one or more state-mapped hazard areas, including the following specific areas: Earthquake, flood and fire effect some areas and regions more than others. Through Federal and State government resources, more information than ever is available to the perspective home buyer.  This Realtor provides each of his home buying clients the most up to date information available about these issues and advises the home seller to provide other necessary information to the buyer as well.

         

 Indoor Air Pollution

Since indoor air pollution and especially mold contamination have become important issues, every home buyer or seller should be informed.  This Realtor provides disclosures regarding this subject to his clients prepared by the California Association of Realtors. Recently a new organization was formed, the American Indoor Air Quality Council which certifies inspection firms providing related inspection services.

Among the various services provided by outside contractors during the sale, the pest control inspection  and resulting treatment or repair is often the most important.  This inspection, determining the presence of wood destroying pests, typically is required in most residential purchase agreements.
